General terms and conditions of use of the online reservation service for parking spaces at Basel-Mulhouse Airport

Clause 1. DEFINITIONS

“GTCU”: these General Terms and Conditions of Use

“Service”: the online parking reservation service on the Basel-Mulhouse Airport website for the parking spaces on which the Service is based.

“User”: any physical person of legal age with legal capacity to contract on their own, or a third party’s behalf, using the Service under the terms and conditions defined in the present GTCU.

“Parking space”: vacant parking space on the ground inside the reserved car park.

Clause 2. OBJECT

The present terms and conditions of use define the terms and conditions of use of the online parking reservation service offered by Basel-Mulhouse Airport at its car parks.

Basel-Mulhouse Airport is a Franco-Swiss public establishment governed by the International Convention of 4th July 1949 concerning its construction and operation, with headquarters in Blotzheim (68730).

The present general terms and conditions of use are online on the website www.euroairport.com.

Use of this Service implies acceptance without reservation of the present general terms and conditions of use that prevail over any other document.

The Service enables the reservation of parking spaces via the website www.euroairport.com, for the parking spaces on which the Service is based, for a given person, a specific date and defined duration. This offer is based on a number of spaces offered within the constraints of the available spaces at the time of the application.

During the reservation process, Users can enter their vehicle registration number so the barriers can open automatically provided the number plate is easy to read.

Clause 3. SCOPE

Access to the Service is reserved for Users wishing to park a private vehicle (land motor vehicle with a maximum of 9 seats, built and designed to transport people, with at least 4 wheels and permissible gross laden weight under 3.5 tonnes), maximum length of 5 metres and maximum height of 1.90 metres.

Clause 4. RESERVATION TERMS AND CONDITIONS

Users certify they are physical persons of legal age acting on their own behalf or for a legal person they are duly authorised to represent. They declare they have full capacity to contract.

Users of the Service complete the required fields in the application form on the website and accept the present GTCU. Basel-Mulhouse Airport reserves the right to reject applications containing inaccurate or incomplete information.

Reservations will take effect subject to:

- Availability of the car park

- Availability of parking spaces

- Acceptance of payment by User’s bank

- User’s prior acceptance of the GTCU

Reservations can be made up to six (6) months before the date the vehicle enters the car park: No reservations are taken two (2) hours before the date of entry, depending on the conditions stipulated for each product.

Subject to the stipulations in Clause 5 herein concerning overstays, parking duration is the duration defined by the departure and arrival dates provided by the User on the online reservation site:

− date and time of departure = date and time of entry to the car park entered in the reservation

− date and time of arrival = date and time of exit from the car park entered in the reservation

By accepting the GTCU, Users expressly accept that performance of the Service may begin before the end of the withdrawal period contemplated in Clause 8.2 below.

Reserved parking duration may not exceed thirty (30) consecutive days. Successive reservations for continuous periods are forbidden.

When the reservation form has been duly completed, the reservation validated and payment made, Users receive a confirmation email at the email address indicated during the reservation: this email contains a summary of the order, the Flash QR code for presentation to enter the car park and the invoice for the order.

Parking spaces can be accessed at the earliest two (2) hours before the dates and entry time indicated on the reservation, depending on car park opening hours.

Clause 5. VALIDITY OF THE RESERVATION

5.1 Car park

Reservations can only be used for car parks intended for this purpose and indicated as such on the reservation website.

Users may only park their vehicles in the parking space selected during the reservation.

Breach of the terms and conditions of the reservation or improper use of the car parks shall not entitle Users to any refund.

No refund shall be paid if the vehicle enters the car park outside the stipulated time slot or under any other terms. In particular, any other method of access shall cause the reservation to become null and void without refund.

There shall be no refund on cars parked for a shorter time than that contemplated in the online reservation.

Basel-Mulhouse Airport reserves the right to change at any time the car parks available for reservation as well as the dates and duration of the Service.

5.2 Parking

When Users arrive at the car park entry barrier (at the indicated time), they present the optical scanner with the QR code emailed to them when they made the reservation, printed on paper beforehand or directly downloaded to an electronic communication device (smartphone, tablet, other).

Upon entry, the barrier issues Users with a ticket they must keep with them until the day they leave the car park: this ticket enables exit from the car park.

Users are free to park where they want inside the reserved car park, subject to the stipulations in Clause 3 in compliance with the areas marked on the ground and the places reserved for people with reduced mobility. Upon exit, provided the timeslot has not been exceeded, Users insert the parking ticket into the scanner at the exit barrier in order to leave the car park. The parking ticket is no longer usable and exit is final. Users who exceed the timeslot must pay for excess time before they leave at the exit barrier (French sector only) or at the automatic pay stations.

The confirmation email sent is strictly personal and confidential. It contains a QR code which it is strictly prohibited to reproduce or forge. It may not be assigned or transferred to a third party. Basel-Mulhouse Airport accepts no liability for tickets used by a third party or used fraudulently.

In the event of difficulties, Users may call a Basel-Mulhouse Airport agent (hereinafter ”Agent”) on the interphones located at car park entrance and exit barriers. Agent then verifies the User’s reservation on the database before permitting access or entry to the car park.

Basel-Mulhouse Airport authorises early arrivals two hours (2h) in advance and exits are authorised subject to compliance with the timeslot indicated on the reservation confirmation email (end of the paid timeslot). After these times, overstays will be invoiced according to the charges defined in Clause 7 below. If an overstay enters a new charging period, that period must be paid for in full.

Basel-Mulhouse Airport cannot be held liable for any overstay at the reserved parking space. Users must allow sufficient time between their flight arrival time and exit from the car park as well as journey time and turn round times for the car parks operating with a shuttle service.

All exits from the car park are final.

Users must therefore allocate sufficient time between their flight arrival time and exit from the car park (conveyance to the airport, delay at baggage reclaim, waiting time for the shuttle, etc.).

Basel-Mulhouse Airport cannot be held liable for overstays of reserved timeslots due to external events or their consequences.

Clause 6. FINAL CONFIRMATION

The different stages in the reservation are detailed throughout the reservation process on the Basel-Mulhouse Airport website.

Users are informed of Service characteristics and availability.

The contract is validated through the “double click” procedure. Users may at any time before confirming the order verify the details of the reservation, the total price and correct any errors.

After having seen and accepted the GTCU by ticking the box “I have read and accept the general terms and conditions of use” User finalises and confirms the reservation.

User then receives a summary of the reservation information in an automatic confirmation email after the payment confirmation page has been displayed. User is advised to file or print the confirmation email and certificate of payment.

Any new reservation by User will not be accepted until User has paid any amounts due on previous reservations in full.

Clause 7. CHARGE AND PAYMENT TERMS AND CONDITIONS

The Service is paid for at the time of the order and only by bank card, through a secure payment system.

Cards accepted for payment are listed on the website.

Users explicitly acknowledge they are entitled to use the bank card used to make the payment. The amount debited is the amount corresponding to the characteristics of the Service (date, duration, car park, options, any administrative fees, etc.).

All prices are indicated in euros (€) in the French sector and in Swiss Francs (CHF) in the Swiss sector, inclusive of all taxes. Prices may change and can be updated at any time.

Invoiced prices are the prices in force on the day when the reservation is confirmed. Prices may change in relation to the car park fill rate.

The price at the barrier and the price at reservation may be different.

Any overstay payment must be made at the car park exit barrier (French sector only) or at the automatic pay stations.

If the reserved timeslot is exceeded, Users are invited to refer to the charges posted directly in situ and on the Basel-Mulhouse Airport website.

Basel-Mulhouse Airport does not charge any administrative fees for using the Service.

The reservation is paid for at the time of online reservation.

Invoices are issued according to the information Users provide on the reservation form (identity, billing address, etc.). The invoices are attached to the confirmation email received by Users at the email address they provide.

Clause 8. CANCELLING AND CHANGING THE RESERVATION

5.1 Change

Reservations cannot be changed after payment has been made.

8.2 Withdrawal within the legal period

Under Articles L.121-21 and following in the Consumer Code, Users are entitled to withdraw within fourteen (14) days counting from confirmation of the reservation, without having to provide justification or pay a penalty. This time period runs from acceptance of the offer.

To exercise this withdrawal right, Users can directly cancel the reservation on the reservation website by clicking on the link “Manage my reservation” or by using the withdrawal form or any other document provided the intention to withdraw is clearly specified. The document can be sent to the Airport’s Access and Car Park Service by ordinary mail or to the email address apresa@euroairport.com. In all cases, the withdrawal document must contain at least the User’s surname and first name together with the reservation number and a copy of the User’s identity document.

Withdrawal within the legal period is not billed.

User will then be refunded the entire price (cost of the reservation and as appropriate the cancellation option cost) within fourteen (14) days counting from the date when Basel-Mulhouse Airport is notified of the User’s decision to withdraw. The refund is made directly to the bank account attached to the bank card used to make the reservation.

Under Article L 121-21-8 of the Consumption Code, Users may no longer exercise their withdrawal right when the Service has begun with their agreement, before the end of the withdrawal period which they have expressly waived.

8.3 Cancellation after the legal period

8.3.1 Cancellation after the legal period without the cancellation option

After the legal withdrawal period, the reservation can be cancelled up to the planned date and time of entry to the car park. In order to cancel, Users must click on the link “Manage my reservation” on the reservation website.

Users are refunded within fourteen (14) days counting from the date when Basel-Mulhouse Airport is informed of the cancellation request:

- In full for cancellations within forty-eight (48) hours before the planned date and time of entry to the car park.

- 50% of the reservation price for cancellations within twenty-four (24) hours before the planned date and time of entry to the car park.

- No refund is possible for cancellations with less than twenty-four (24) hours before the planned time and date of entry to the car park.

The refund, deducted as appropriate from the cancellation option amount, is made directly to the bank account attached to the bank card used for the reservation.

8.3.2 Cancellation after the legal period with cancellation option

When placing the order on the website, Basel-Mulhouse Airport offers Users a cancellation option. This payment option permits a reservation to be cancelled with a refund as follows:

- Parking costs: refundable up to the last minute

- Cancellation costs: non-refundable.

The refund is made directly to the bank account attached to the bank card used to make the reservation.

The cancellation option is defined in euros and costs three (3) euros for car parks on the French side. It is defined in Swiss francs and costs four (4) CHF for cark parks on the Swiss side Users who sign up to the cancellation option can cancel their reservation at any time until the planned date and time of entry to the car park.

The cancellation option cannot be changed or refunded.

Clause 9. APPLICABLE LEGISLATION

The terms and conditions of use of the Airport’s car parks are defined in the following texts which Users undertake to obey:

- The Prefectural order establishing current police measures applicable to the Basel-Mulhouse Airfield.

- The Highway Code.

- The internal regulations for public car parks, posted at the entrance to each car park.

In the case of contradiction between a GTCU provision and an internal regulation of the car parks, these GTCU shall prevail.

According to the current internal regulations for car parks, Users park at their own risk, the fees collected are only parking fees and are not fees for the security, surveillance or deposit of the vehicle. Basel-Mulhouse Airport declines all liability for wear and tear, accident or theft of the vehicle and for all or part of the objects and equipment contained therein.

Any infringement of traffic and parking rules and especially of the highway code, may be penalised with a fine or impoundment.

Clause 10. LIABILITY

Under Article L. 121-19-4 of the Consumer Code, Basel-Mulhouse Airport accepts no liability for non-performance or poor performance of the provision attributable to Users, or third parties unrelated to the service or in cases of force majeure as defined in French law.

Users waive any claim against Basel-Mulhouse Airport and its insurers if a third party uses their reservation number or if it is used fraudulently.

Clause 11. PERSONAL DATA PROTECTION

Basel-Mulhouse Airport gathers personal data to process users’ reservations. This data (surname*, first name*, postal address*, email address*, landline or mobile number, number plate) are intended for the Access and Car Park Service and will be stored for the time required to process the reservation and/or for the storage period stipulated in the applicable legislation on civil and commercial matters. Data marked with an asterisk (*) are required fields for users wanting to make a reservation.

Under French law on Information Technology, Data Files and Civil Liberties no. 78-17 as amended and Regulation (EU) 2016/679 applicable as from 25th May 2018, users have the following rights over their data: right to access, rectify, erase, limit the processing and the right to data portability. Users can also define rules regarding the storage, erasure and communication of their personal data after their death.

For legitimate reasons due to their personal situation, Users may object to the processing of their data.

To exercise their rights Users must write to the Data Protection Officer (DPO), Aéroport de Bâle-Mulhouse, BP 60120, F-68304 Saint-Louis Cedex. All requests must be accompanied by a photocopy of the User’s identity card. The Airport advises Users to send such letters by registered post with acknowledgement of receipt.

In the event of breach of the above provisions, Users may file a complaint with Commission Nationale Informatique et Libertés – CNIL (France’s National Commission for Information Technology and Civil Liberties) Airport websites use cookies to take users’ preferences into account and optimise their web pages. These cookies are never used to fraudulently collect personal data. They enable Basel-Mulhouse Airport to measure the audience, improve navigation and locate malfunctions.

Users may object to cookies by configuring the parameters on their browser, as indicated in the Data protection and cookies policy. In such cases, access to certain services and parts of the site may be altered or even impossible.

Clause 12. VALIDITY - AMENDMENTS TO THE GENERAL TERMS AND CONDITIONS OF USE

The applicable GTCU are those in force and on line on the day the reservation is made on the Basel-Mulhouse Airport website.

Basel-Mulhouse Airport reserves the right to change the Service and amend the present GTCU without notice.

Clause 13. MEDIATION

In the event of dispute over use of the Service, Users/consumers may write to Médiation du tourisme et du voyage - MTV (France’s Travel and Tourism Mediation body) - By post to the following address: BP 80303 75823 Paris cedex 17, or directly via its website http://www.mtv.travel/

Clause 14. GOVERNING LAW AND JURISDICTION

The present agreement is governed by French law.

If no amicable settlement is reached, Users/consumers may choose:

• one of the territorially competent jurisdictions under the Civil Procedure Code, that is, the court of the defendant’s address or company headquarters, the court of the place of effective physical delivery or place of performance of the service.

• The court of the place where they were living when the contract was signed or of the place where the harmful event occurred.

Information received by Basel-Mulhouse Airport is processed for the purpose of managing online parking reservations. This information is intended for the Access & Car Parks Service and will be stored for the period stipulated in the relevant legislation and in particular, legislation on civil and commercial matters.

Under French law on Information Technology, Data Files and Civil Liberties no. 78-17 as amended and Regulation (EU) 2016/679 you have the following rights over your data: access, rectification, erasure (right to be forgotten), limitation on processing and data portability. You may also define the instructions on the storage, erasure and communication of your personal data after your death.

For legitimate reasons, you may object to the processing of your personal data.
